1. Subject

Simple Limited Liability Company MULLEEX j.d.o.o. (hereinafter referred to as “MULLEEX”) has developed a platform for advertising the transport of goods, which is available on the website mulleex.com or as a mobile application, and is intended to connect drivers of private and legal vehicles or transport companies and crafts, traveling between destinations, with shippers of goods.

The terms and conditions of use serve to regulate the access and terms of use of the platform. Please read them carefully. You are aware of the fact and accept that mulleex.com is not one of the parties to any agreement, contract or contractual relationship of any kind entered into between the members of the platform.

By clicking on “Register by e-mail”, you confirm that you have read the general terms of use and accepted the entire text.

2. Definitions of terms

Interpretations of the meaning in this document,

“Offer” is an advertisement for the free transport space of goods between two specific locations published on the platform by the driver.

“Advertisement” is an advertisement about the services of professional companies that the owner or an authorized person publishes on the MULLEEX platform.

“MULLEEX” has the meaning set forth in Article 1;

“Terms and Conditions” refers to the terms and conditions of use;

“User Account” is your personal account that you must open in order to become a member and have access to certain services offered through the platform;

“Driver” is a member who, through a platform, offers to another person, who requests the transport of goods, the transport of goods between certain sections in a certain period of time;

“Content for Members” has the meaning set forth in paragraph 11.2 below;

“Member” is a person who has created an account on our platform;

“Goods” are tangible or intangible goods whose basic property is to satisfy certain human needs;

“Platform” has the meaning set forth in Article 1;

“Services” are all services provided by MULLEEX j.d.o.o. provides through our platform;

A “web page” is a web page available at www.mulleex.com

“Transport” means the transport specified in the advertisement published by the driver on the platform and for which he agrees to transport the goods to another member of the platform;

3. Registration on our platform and creating a personal account

3.1. Conditions for registration on the platform

This platform may only be used by persons over 18 years of age. Registration of minors on this platform is strictly prohibited. By accessing, using or registering on the platform, you personally declare and warrant that you are over 18 years of age.

3.2. Creating an account

The platform allows members to publish and view transport advertisements and interact with each other between platform members in order to execute transport arrangements. If you are not registered on our platform, you cannot see our ads. It is not possible to publish an ad unless you create an account and become a member of our platform.

To create an account you need:

To register on the platform, you must first read and accept these terms and conditions of use and the Privacy Policy.

When creating your account you have agreed to provide us with accurate and true information and update it on your profile or by sending a notice to MULLEEX. j.d.o.o., to guarantee the relevance and accuracy of the data in accordance with the contractual obligations you have with MULLEEX j.d.o.o.

In the case of e-mail registration, you accept the protection of the confidentiality of your password that you chose when creating your account and you should not disclose it to anyone. If you lose or disclose your password, you are responsible for notifying MULLEEX j.d.o.o. You are solely responsible for the use of your account by third parties, unless MULLEEX j.d.o.o. you have not notified of the loss of the password or unauthorized use by a third party or the disclosure of the password to a third party.

You agree that you will not create or use, using your identity or the identity of a third party, user accounts other than those you originally created.

3.3. Verification

MULLEEX j.d.o.o. may, for the sake of transparency, confidence building, prevention or detection of fraud, establish a system to verify some of the information you provide on your profile. This applies, for example, to entering a phone number or sending an identification document.

You acknowledge and agree that all information on the platform that states that it has been “verified” is only a confirmation that the member has successfully completed the verification process on the platform, in order to provide you with information on free transport space. MULLEEX j.d.o.o. cannot guarantee the truthfulness, reliability or validity of the information subject to the verification procedure.

4. Use of Services

4.1. Posting ads

As a member and if you meet the conditions below, you can create and publish ads on our platform by entering information about the planned transport (date of transport, time of transport, place of departure and arrival, the size of available transport space, etc.).

When posting an ad, you can specify which places you agree to stop and briefly pick up or leave the goods. Travel sections between these places or between that place and the place of departure or destination are called “Shares”.

You may post an ad if you meet the following conditions:

you have a valid driver’s license;
post only advertisements for a vehicle that you own or use with the express permission of the owner, and in any case that you are authorized to use to transport the goods;
you are and remain the main driver of the vehicle that is the subject of the advertisement;
the vehicle has valid compulsory insurance
you do not have any contraindications or medical incapacity to drive;
do not offer more transport space than there is space in your vehicle;
the vehicle you are using is in good condition and in accordance with the applicable legal provisions and practices, and this applies in particular to the most recent technical inspection certificate.

You acknowledge that you are solely responsible for the content of the ads you post for transport. You also declare and guarantee the accuracy and truthfulness of all information stated in the advertisement and undertake to carry out the transport in accordance with the conditions stated in the advertisement.

If your ad meets the terms and conditions of use, it will be published on the platform and as such visible to members searching the MULLEEX.COM platform. MULLEEX j.d.o.o. reserves the right, in its sole discretion and without notice, not to post or remove, at any time, any advertisement that does not comply with the terms and conditions of use or that the company deems to harm its reputation, the reputation of the platform.

You acknowledge and agree that the criteria taken into account when sorting and ordering the advertisements among other advertisements are the sole discretion of MULLEEX j.d.o.o ..

4.2. Grading system

4.2.1. How the system works

MULLEEX j.d.o.o. encourages you to rate members after the transport is done.

Your grade and the grade given to you by another member, if you have received it, are visible and are published only on our platform.

You have the option to respond to the rating received on your profile. The rating and your answer will be published on your profile.

4.2.2. Content moderation

You acknowledge and agree that MULLEEX j.d.o.o. reserves the right to remove any ratings, questions or comments if it considers that their content violates these terms and conditions of use.

5. Financial conditions

5.1. Cost participation

Participation in the cost is determined by the provider and the service seeker, at their own risk. Legal entities or crafts have the right to make a profit through the MULLEEX.COM platform

6. Platform user behavior

6.1. Obligations of all platform users

You hereby acknowledge that you are responsible for complying with all laws, regulations and obligations that apply to your use of the platform.

When you use the platform during transport, you undertake:

that you will not infringe the rights and reputation of MULLEEX j.d.o.o., in particular intellectual property rights;
that you will not open more than one user account on the platform and that you will not open an account on behalf of a third party unless you have legal permission to do so;
not to speak, behave, or post content on the platform that is considered abusive, immoral, harmful, vulgar, offensive, aggressive, undesirable, threatening, abusive, racist, or xenophobic, with sexual connotations, that incites settlement, discrimination, or hatred, which encourages actions related to the use of illegal substances or which is generally contrary to the purpose of this platform which could violate the rights of MULLEEX j.d.o.o. or a third party or that is contrary to good morals;
MULLEEX j.d.o.o. (after creating or updating an account) that you will not send any false, misleading, malicious information to other members;
that you will not contact another member of the platform through the platform for a purpose that does not include determining the conditions for the transport of goods;
that you comply with these terms and conditions of use and data protection policy.

6.2. Obligations of the driver

When you use this platform as a driver you agree;

Post ads that relate only on actually planned transportation;
that you will provide MULLEEX j.d.o.o. or to the service seeker who requests it to show his driver’s license, vehicle registration certificate, insurance policy, certificate of technical inspection and all other documents proving on the platform your ability to use the vehicle as a driver;
realize the transport stated in the advertisement and adhere to the agreed terms and places of transport (especially the place of departure and destination);
that you will not take more goods than stated in the advertisement
in the event of a delay or change in transport time, inform your service providers as soon as possible;
use the correct vehicle, which is in accordance with the applicable legal provisions and practice, especially those related to the valid certificate of the performed technical inspection of the vehicle;
comply with the laws, regulations and codes applicable to driving and vehicles, and in particular those relating to the validity of compulsory insurance at the time of transport and the possession of a valid driving license;
in the case of cross-border travel, obtain both the applicant for the service and any competent authority that so requests, make available all documents proving your identity and your right to cross the state border;
meet with the service seeker at the agreed place of departure at the agreed time;
that you do not have any contraindications or health condition that would cause you to be unable to drive
enable transport service users to contact you by telephone, at a number registered on your profile, including at the meeting place.
that you will not publish an advertisement relating to a vehicle that you do not own or are not authorized to use for transport purposes

6.3. Obligations of service users

When you use this platform as a user of the service, you agree to:

in the case of cross-border transport, provide the driver as well as any competent authority that requests it, make available all documents necessary for the cross-border transport of goods.
that you will MULLEEX j.d.o.o. or any driver who asks you to show your identity card or any document proving your identity
In the event of a delay, inform the driver immediately

7. Termination of the account, restriction of access and termination of the contractual relationship

Contractual relationship with MULLEEX j.d.o.o. you can terminate at any time, at no cost and without giving a reason. To do so, simply open the ‘Close Account’ tab on your profile page.

In case of violation of these terms of use and provisions, MULLEEX j.d.o.o. has real reason to believe that it should protect its security and integrity, the security and integrity of its members or third parties either for the purpose of preventing fraud or for the purposes of investigations, MULLEEX j.d.o.o. reserves the right to:

termination of this provision and the terms of use which bind you to MULLEEX j.d.o.o., immediately and without special notice, and
prevent posting or remove all ratings, ads, messages, content, or any content you post on the platform, and
Restrict your access and use of the platform as well
temporarily or permanently suspend your account.

You will be notified in advance of the introduction of such a measure, in order to give MULLEEX j.d.o.o. submit your explanation. MULLEEX j.d.o.o. will then, at its discretion, decide whether to suspend the measures imposed.

8. Personal data

MULLEEX j.d.o.o. will collect and process your personal data when you use the platform thereby confirming and accepting that MULLEEX j.d.o.o. processes your personal data in accordance with the applicable laws and provisions of the Data Protection Policy.

9. Intellectual Property

9.1. Content published by MULLEEX j.d.o.o.

MULLEEX j.d.o.o. is the sole owner of the intellectual property rights relating to the services, platform, content (especially texts, images, logos, data, graphics) and to the software and databases that ensure their operation.

MULLEEX j.d.o.o. gives you a non-exclusive, personal and non-transferable right to use the platform and services, for your personal and private purposes, on a non-commercial and commercial basis and for the purpose for which the platform and services are intended.

You are prohibited from any other use or exploitation of the platform and services and their content without the prior written permission of MULLEEX j.d.o.o. In particular, you are prohibited from:

perform decompilation and reverse engineering of platforms and services;
reproduce, modify, adapt, distribute, publicly present and distribute the platform, services and content, unless expressly approved by MULLEEX j.d.o.o .;
Extracting or attempting to extract (particularly using data mining robots or similar data collection tools) a significant portion of the data from the platform.

9.2. Content you post on the platform

To enable the provision of services, MULLEEX j.d.o.o. you give a non-exclusive license to use the content and data you provide in the context of your use of the Services (the “Member Content”). To MULLEEX j.d.o.o. enable distribution via the digital network and in accordance with communication protocols (especially via the Internet and mobile network) and to make the content of the platform available to the public, you authorize MULLEEX, for the whole world and for the entire duration of your contractual relationship, to use, display, adapt and translate content of members, as follows:

MULLEEX j.d.o.o. authorize you to use all or part of your member content on digital media to record data (known or not yet known), in particular servers, hard disk, memory cards, or equivalent media, in any format and using any the process, known or not yet known, to the extent necessary to carry out storage, backup, transfer or retrieval related to the operation of the platform and the provision of services;
MULLEEX j.d.o.o. you authorize the adaptation and translation of members’ content and the use of such adaptations on all digital media, currently known and future, regulated by the previous point, for the purpose of providing services, in different languages. This right includes in particular the option to change the formatting of members’ content, while respecting your moral right, in terms of respecting the charter on graphic content on the platform and / or making the content technically compatible for display when published on the platform.

10. The role of MULLEEX j.d.o.o.

This platform is an Internet networking platform on which all its members can create and publish advertisements for the transport of goods. These ads can be viewed by other members to find the appropriate transport directly from the member who posted the ad on the platform and arrange the transport of goods in the specified vehicle.

MULLEEX j.d.o.o. has no control over the behavior of its members and platform users. It does not own, use, supply or operate the vehicles that are the subject of the advertisement and does not offer any transport on the platform.

By using the platform and accepting these terms and conditions of use, you accept that MULLEEX j.d.o.o. is not a party to any agreement that you have entered into with other members in terms of costs related to the transport of goods.

You acknowledge and agree that MULLEEX j.d.o.o. does not control the validity, truthfulness or legality of the published advertisements and the places and transport offered. As an intermediary for the connection for the purpose of the transport arrangement, MULLEEX j.d.o.o. does not provide any transportation services or act as a carrier, and its role is limited to providing access to the platform.

Members (drivers or users of transport services) are personally and fully responsible for their actions.

As an intermediary, MULLEEX j.d.o.o. cannot be held responsible for the actual realization of transport, especially in the following cases:

incorrect information published by the driver in his advertisement or if it is any other information related to transport and transport conditions;
cancellation or change of transport by a member;
non-payment of participation in the cost by the user of the transport service;

11. Operation, availability and operation of the platform

MULLEEX j.d.o.o. it is mandatory to try to keep the platform available 7 days a week, 24 hours a day. Access to the platform may in certain cases be suspended, without warning, due to technical maintenance, migration and data updates, or due to power outages or network-related restrictions.

MULLEEX j.d.o.o. reserves the right to change or suspend, in whole or in part, access to the platform and its functions, at its discretion, temporarily or permanently.

12. Changes to the Terms and Conditions of Use

The terms and conditions of use and the documents which, by reference to them, form an integral part thereof, constitute the entire agreement between you and MULLEEX j.d.o.o. regarding your use of the Services. Any other document, especially the citation on the platform (frequently asked questions, etc.) serves only as a guide.

MULLEEX j.d.o.o. may change its terms and conditions of use to adapt them to its technical and commercial environment and to comply with applicable legislation. All changes to the terms and conditions of use will be posted on the platform, stating the date of the change and with prior notice of the change.

13. Applicable law – Settlement of disputes

These terms and conditions of use are written in Croatian and are subject to Croatian law.

If you need your complaint regarding the platform or our services, you can also submit it on the dispute resolution platform published on the Internet by the European Commission and which is available to you here. The European Commission will send your complaint to the competent national ombudsman. In accordance with the applicable regulations relating to mediation, Fr. you are obliged, before submitting any request for mediation, to MULLEEX j.d.o.o. notify any dispute in writing so that you can try to resolve it amicably.

14. Legal notices

This platform is published by MULLEEX j.d.o.o. with a share capital of HRK 10, registered in the Commercial Register in POZEGA , with its registered office at Osječka ulica 57a, 34308 Jakšić, Republic of Croatia, represented by the President of the Company
